Official Rules
NO PURCHASE OR REFERRAL REQUIRED TO ENTER OR WIN. U.S. ONLY. VOID IN PUERTO RICO AND WHERE PROHIBITED.
- Eligibility: The TextbookX.com $500 Cash Sweepstakes (the "Sweepstakes") is open only to legal residents of the United States, who are at least 18 years of age at the time of entry. Employees, officers and representatives of Akademos, Inc. ("Akademos"), all promotional or fulfillment agencies involved in the Sweepstakes and their respective related companies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to participate. The Sweepstakes is subject to all federal, state and local laws and regulations. Odds of winning in the Sweepstakes depend on the number of eligible entries received for the drawings.
- Sponsor: Akademos, Inc. 25 Van Zant Street, Norwalk, CT 06855
- Agreement to Official Rules: By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Akademos, which are final and binding.
- Timing: Sweepstakes begins August 10, 2006, with the first prize drawing on October 31, 2006. Akademos reserves the right to discontinue this sweepstakes at any time after the first drawing (the "Promotion Period").
- How to Enter: All visitors entering a valid promotional code through during order check out will be entered in the sweepstakes. Alternate entry into the drawing can be achieved by sending a letter containing your email address for contact purposes by standard mail, at: The TextbookX.com $500 Cash Sweepstakes, 25 Van Zant Street, Norwalk, CT 06855. Mailed entries received after a designated drawing period will be carried into the next drawing period, provided the program continues. If the mailed entry is received after the last drawing has completed, the entry will be discarded, even if the postmark date is within a valid drawing timeframe. For all entries: LIMIT: One (1) entry per person. All entries become the exclusive property of Akademos, Inc., and none will be acknowledged. Proof of sending or submission will not be deemed to be proof of receipt by Akademos. Akademos is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, mutilated, misdirected or postage-due entries, which will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
- Prize Drawings: There will be a total of one (1) random drawing for one (1) prize to be conducted on or about October 31, 2006. The drawing, and any subsequent drawings thereafter, will be conducted in accordance with these Official Rules by employees of Akademos, whose decisions as to the administration of the Sweepstakes and the selection of potential winners are final. Winners must allow Akademos to display the following information about themselves, to be used only in a promotional capacity, in order to receive the prize: First name, College name, a personal digital photo of themselves. Winners will be notified via email. Entrants selected must comply with all terms and conditions of these Official Rules. Winning is contingent upon fulfilling all requirements. Except where prohibited, potential winners must sign and return to Akademos, within ten (10) days of being notified, an affidavit of eligibility (including compliance with these Official Rules) and liability/publicity release in a form designated by Akademos in order to claim his/her prize. If a potential winner cannot be contacted within ten (10) days after the first attempt to contact him/her or if he/she fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, an alternate entrant will be selected in his/her place at random from among all eligible entries received. If suitable alternate winners cannot be obtained on or before the designated prize period, all unawarded prizes will remain unawarded.
- Prizes: One (1) winner for the first drawing will receive a one-time check for the amount of $500.00. No other substitution, assignment or transfer of prizes is permitted, except by Akademos, who reserves the right to substitute a prize or prize component with another of comparable or greater value. Winner is solely responsible for all taxes and fees associated with prize receipt and/or use.
- Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner's consent to Akademos' use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
- General Conditions: Akademos reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond Akademos's reasonable control impairs the integrity of the Sweepstakes, as determined by Akademos in its sole discretion. In such event, Akademos reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Akademos reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Akademos reserves the right to seek damages from any such person to the fullest extent permitted by law. Akademos's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
- Release: By entering this Sweepstakes, entrant agrees to release and hold harmless Akademos and all promotional and fulfillment agencies and each of their related companies, and each of their respective officers, directors, employees, shareholders, and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize.
- LIMITATIONS OF LIABILITY: IN NO EVENT SHALL AKADEMOS, PROMOTIONAL AND FULFILLMENT AGENCIES, THEIR RELATED COMPANIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS OR AGENTS (COLLECTIVELY HEREIN, "SPONSORS") BE LIABLE FOR: (i) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, THE MALFUNCTIONING OF ANY COMPUTER, CABLE, NETWORK, HARDWARE OR SOFTWARE; (ii) THE UNAVAILABILITY OR INACCESSIBILITY OF ANY TRANSMISSIONS OR TELEPHONE OR INTERNET SERVICE; (iii) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE SWEEPSTAKES; (iv) ELECTRONIC OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE SWEEPSTAKES OR THE PROCESSING OF ENTRIES; (v) ANY INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO LOST PROFITS OR LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, TO PERSONS OR PROPERTY, INCLUDING, BUT NOT LIMITED TO, ENTRANT'S COMPUTER, HARDWARE OR SOFTWARE, WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM ENTRANT'S PARTICIPATION IN THE SWEEPSTAKES OR THAT ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH THE USE, OR THE INABILITY TO USE, THE TEXTBOOKX.COM WEBSITE OR THE SERVICES OR MATERIALS ON THE SITE, EVEN IF ADVISED OF THE POS SIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE SPONSORS EXCEED THE TOTAL CHARGES SET FORTH IN THE ITINERARY GIVING RISE TO SUCH LIABILITY. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. YOUR USE OF THE SITE SHALL BE AT YOUR OWN RISK.
- Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than the administration of the Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Connecticut (Eastern Division), or the appropriate Connecticut State Court located in Hartford County, Connecticut; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Akademos in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Connecticut without giving effect to any choice of law or conflict of law rules (whether of the State of Connecticut or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Connecticut.

- Winners List: Sweepstakes results and a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to: The TextbookX.com $500 Cash Sweepstakes Requests, 25 Van Zant Street, Norwalk, CT 06855. Requests for Sweepstakes results must be received by January 31, 2007. Vermont residents may omit return postage.
