Description: Since the production of its first edition in 1985, this monograph has been widely accepted as the most authoritative and comprehensive exposition of the law of auctions in English law. This new edition has been extensively revised with numerous detailed changes affecting both law and practice. The authors begin by putting new English cases through careful and detailed analysis, but then move to bring the work further forward with a detailed exploration of the growing body of European and International law which increasingly affects auctions. Areas discussed include the statutory basis for sales of land by auction which has been radically altered by the Law of Property (Miscellaneous) Provisions Act 1989; vitally important case law clarifying the auctioneer's duties in relation to accurate description particularly with regard to the Trade Descriptions Act 1968; the duty of care in identifying valuable objects consigned for sale; and problems of title to goods. In the light of new EC legislation, fundamental changes to both export licensing rules and the position with regard to the safety of goods sold are examined in detail. In the ten years that have passed since the first edition of this book the authors have participated in a number of conferences with professional auctioneers. Their experience in answering an array of diverse questions relating to the law and practice raised at these conferences has been fruitfully employed in this completely revised and up-to-date text. This practical work of reference is equally a serious academic study of a neglected yet fascinating subject of which the authors are recognized authorities.
