Terms and conditions of use
You acknowledge and agree that this site, and its contents, are provided by Akademos.com on an "AS IS" and "AS AVAILABLE" basis. Akademos.com makes no representation or warranties of any
kind with respect to the site, the contents thereof, appropriateness or fitness of use or merchantability. Akademos.com cannot and does not warrant that the information or merchandise provided
through this site is accurate, complete or current.
The information provided through this site, including but not limited to the book list, price, and availability, is subject to change without prior notice and at any time. The price information provided is not intended to and shall not be deemed to constitute a contract or an offer to form a contract, but is an advertisement for an offer. Akademos.com, its directors, officers, employees, agents, content providers and any and all third party involved in the development or maintenance of this site expressly disclaim any and all liability of any nature and kind.
"List Price" is the suggested retail price provided to us by publishers. Actual retail prices in your area may vary. Because we sell our merchandise over the Internet on a national basis, it is not possible to know if our merchandise is sold at list price in any particular location or at any particular time. "You Save." reflects the difference between our price and the publisher-provided list price shown on our sites. Because the list price may be different than the actual retail prices in your area, you may not actually realize a savings of this amount and may want to make an exact comparison for yourself by checking the prices of other Internet or local retailers prior to making a purchase.
Akademos.com reserves the right, in its sole discretion, to change, suspend or discontinue any or all constituent parts of this site, including the availability thereof, effective upon publication on this site.
RENTAL TERMS OF SERVICE
By renting an item from Akademos, Inc., through its TextbookX.com website and affiliated school-branded TextbookX.com websites, hereafter referred to as TextbookX, you agree to the following rental terms and conditions.
Privacy of Personal Information
Condition of Books
Books rented from TextbookX.com are guaranteed to be correct according to your order, and in an acceptable used or new condition. Supplemental materials, such as student access codes, CD ROMs, or supplemental workbooks are not guaranteed to come with your books even if the title of the book contains language regarding CD ROMs or other forms of supplements. Although we do our very best to find books that include all their supplements, many such materials are one-time use and are not available through our suppliers in used condition. Be sure before you order that you either have access to these supplements or that you don't actually need them for your class; otherwise please purchase a new copy of the item instead of renting it.
TextbookX.com relies on the expertise of our shipping providers which are USPS, UPS, and FedEx to get your books to you on time. Rare problems such as weather delays, rural routes, or shipping carrier system delays could impact delivery. Should a problem arise, the TextbookX.com Customer Service Team will work to rectify the delivery problem or send out a replacement textbook at no cost to you.
Books rented from TextbookX.com are the property of TextbookX.com or its rental partners. At no time during the rental period does the renter obtain ownership of the books unless the renter purchases the book during the rental period or is charged by TextbookX after the rental return date due to non-compliance of rental return.
Agreement to Return Books
You agree to return rented textbooks to TextbookX.com or its rental partners according to the specific instructions provided during your rental period, using the prepaid shipping label on or before the last day of your rental period. Books that are not returned to the specified returns center will not be cleared from your account. Please make sure you are using the supplied prepaid USPS shipping label to return all books. They are provided free of charge and provide both us and you definitive tracking of your books. For more information on your specific rental, please login to your bookstore account and click on your order detail from your account's Purchases section.
Books Not Returned on Time
We will do our best to make returning your books simple and easy. However, if books are not returned at the end of the rental period as specified in the rental agreement, the renter will be charged for the replacement cost of the rented item. The non-returned item will then become property of the renter. Returned items should be posted for return prior to the rental return date. Returns with post-marks after the rental return date may not arrive in time for the return to be processed, and will be subject to a replacement charge. If your credit or debit card cannot be charged for the price of the non-returned book, we may advise your college to deduct the amount from your account, either through a financial aid withdrawal or a bursar’s charge. We also reserve the right to enter into collections to recover the lost merchandise value. We work very hard to resolve every return discrepancy. After all, our goal is to keep you as a happy customer and continue to rent textbooks to you throughout your college career.
Maintenance and Care of Textbooks
You, the renter, agree to keep textbooks in an acceptable used condition. TextbookX.com or its rental partners are liable and responsible for the condition of rented textbooks only until they are received by the renter at the onset of the rental period. At the time of initial receipt, you, the renter, take full responsibility for the care and condition of the textbook. If lost, stolen, or damaged beyond reasonable use (cover ripped off, pages torn out, excessive water damage, etc.), the renter will be charged the full replacement value for the textbook. TextbookX.com and its rental partners understand that there will be normal wear and tear on a textbook during a rental period. Excessive damage is any damage that would prevent another student from reasonably being able to use and gain the full learning value from the textbook.
Buying Your Books
If you decide you want to keep your book forever, simply access your account and select the book or books you wish to buy. Then select the "Buyout" button. This amount is the difference between what you already paid in rental fees and the replacement value of the book. If you decide to purchase the book, simply follow the prompts after choosing this option and your account will be updated to show the new status.
Right to Cancel Orders
TextbookX.com and its rental partners retain the right to cancel or refuse any order that results from an error in pricing due to typographical errors, miscommunication with our partners, or any other incorrect information.
TextbookX.com and its rental partners shall not be held liable for any damages incurred, physical or emotional, tangible or intangible, beyond the rental price of the textbook. Books which are lost in transit will be replaced at no extra charge (subject to the availability of a replacement) or refunded in full; however, TextbookX.com and its rental partners shall not be held liable for poor performance in school or any other matter stemming from the rental or non-receipt of your textbooks. You, the renter, agree to resolve disputes directly with TextbookX.com and/or its rental partners, and not through a third party.
